OVERVIEW
Welcome to RDM. The terms "we", "us" and "our" refer to RDM, an Australian business operating this store and website (the "Services"). These Terms of Service describe your rights and responsibilities when you use the Services.
Please read these Terms carefully — they include important information about your legal rights, including limitations of liability and our governing law in Australia. By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
Section 1 — Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer right or guarantee that applies to you under the Australian Consumer Law (ACL) or any other applicable law. Where you are a "consumer" under the ACL, our goods come with statutory guarantees that cannot be excluded.
Section 2 — Access and Account
By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory. You are responsible for the accuracy of all information you provide and for keeping your account credentials secure. You may not transfer, sell, or assign your account to another person.
Section 3 — Our Products
We aim to display our products accurately. Colours and appearance may vary on different devices. Descriptions and prices may change at any time without notice. We reserve the right to discontinue products, limit quantities, or refuse orders at our discretion.
Section 4 — Orders and Payment
When you place an order, you make an offer to purchase. We reserve the right to accept, decline, or cancel any order at our discretion before dispatch. Your order is not accepted until we confirm acceptance and process payment. You represent and warrant that the payment information you provide is accurate, you are authorised to use it, and you will pay all applicable charges including shipping and any taxes.
Section 5 — Prices
Prices are in Australian Dollars (AUD) unless otherwise stated. Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and shown in your order confirmation. Unless stated, posted prices do not include GST, shipping, customs, or import charges.
Section 6 — Shipping and Risk
We are not liable for shipping delays caused by carriers, customs processing, or events outside our control. Delivery times are estimates only. Title and risk of loss pass to you once we hand the goods to the carrier. Refer to our Shipping Policy for further detail.
Section 7 — Returns and Warranty
Returns are governed by our Refund Policy and your rights under the ACL. Hardware is covered by our Warranty Policy for 12 months from delivery, in addition to your ACL rights.
Section 8 — Intellectual Property
The Services and all content — including trademarks, brand assets, text, images, graphics, video, and software — are owned by RDM, its affiliates, or its licensors, and are protected by Australian and international intellectual property laws. These Terms permit you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, or republish any content without our prior written consent. The "RDM" name, "Realtime Data Monitoring" name, and associated logos are trademarks of RDM and may not be used without our written permission.
Section 9 — Installation and Vehicle Use
Our products are designed to be installed in vehicles by competent persons familiar with automotive electrical systems. You are responsible for correct installation. You acknowledge that:
- You will follow installation instructions and applicable wiring diagrams
- You will not exceed rated voltages or operating limits
- Use of the product while driving must comply with the road rules in your jurisdiction
- Display data shown by our products is for reference only and may differ from your vehicle's primary instrumentation
Section 10 — Prohibited Uses
You may not use the Services to: violate any law; infringe intellectual property rights; harass or harm any person; transmit malicious code; impersonate any other person; collect or track personal information of others; scrape or interfere with the Services' security features. We may suspend or terminate your access if you breach these Terms.
Section 11 — Disclaimer of Warranties
To the extent permitted by law, and subject to the Australian Consumer Law, the Services and all products provided through the Services are provided "as is" and "as available" without warranties of any kind other than those required by law. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.
Section 12 — Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, RDM's total liability arising out of or in connection with these Terms and the Services is limited to the amount you paid for the goods or services giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages including lost profits, lost data, or replacement costs, even if advised of their possibility. Nothing in this section limits any liability that cannot be limited by law.
Section 13 — Indemnification
You agree to indemnify and hold harmless RDM and its affiliates, officers, directors, employees, agents, and service providers from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your use of the Services.
Section 14 — Third-Party Links and Services
The Services may contain links to third-party sites and use third-party tools (including Shopify which hosts the store, Klaviyo for marketing, and others). We are not responsible for the content, accuracy, or practices of third parties. Use of third-party tools is at your own risk and subject to their terms.
Section 15 — Termination
We may terminate or suspend your access to the Services at any time, in our sole discretion, without notice. The provisions of these Terms that by their nature should survive termination — including intellectual property, limitations of liability, indemnification, and governing law — will continue to apply.
Section 16 — Changes to These Terms
We may update these Terms at any time. Material changes will be notified through the Services or by email. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
Section 17 — Governing Law and Jurisdiction
These Terms are governed by the laws of South Australia, Australia. You and RDM submit to the exclusive jurisdiction of the courts of South Australia for any dispute arising under or in connection with these Terms.
Section 18 — Severability and Entire Agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and Warranty Policy, constitute the entire agreement between you and RDM regarding the Services.
